Terms of Use
Effective date: September 30, 2026
These Terms of Use govern your use of hear-in-noise.com (the "Site"), operated by Sierra Vista Software LLC ("we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Please also read our Medical Disclaimer and Privacy Policy, which form part of these Terms.
1. What the Site is for
The Site provides general information about hearing, along with quizzes and activities for people with hearing loss and anyone interested in hearing. Everything on the Site is for general educational purposes only.
The Site does not provide medical advice, diagnosis, or treatment, and using it does not create a patient–provider relationship. Nothing on the Site is a substitute for advice from an audiologist, doctor, or other qualified professional. For details, see our Medical Disclaimer.
If you notice a sudden change in hearing in either ear, contact a doctor promptly.
2. Using the Site
You may use the Site for your own personal, non-commercial use. Audiologists and other professionals may share links to our pages with patients and clients. If you are under 18, please use the Site with the involvement of a parent or guardian.
When using the Site, you agree not to:
- Copy, republish, or redistribute Site content except as allowed in section 4.
- Scrape, crawl, or harvest content or data by automated means, except for standard search engine indexing.
- Interfere with the Site's security or operation, or try to access parts of it you're not authorized to use.
- Use the Site for anything unlawful, or in a way that could harm us or other users.
We may suspend or restrict access to the Site, or change or discontinue any part of it, at any time.
3. Quizzes, activities, and audio
Our quizzes and listening activities are practice and learning tools. They are not hearing tests. Scores and results do not measure, diagnose, or predict your hearing, and they are not a reason to start, stop, or change any treatment or hearing device.
Some activities play sound. Start at a low volume and raise it only to a comfortable level. Stop if you feel discomfort, pain, dizziness, or ringing in your ears. You are responsible for setting a safe volume on your device and headphones.
Simulations, such as examples of how hearing loss or a hearing device might sound, are rough approximations for illustration. Real experiences vary widely from person to person.
4. Our content
The Site's articles, quizzes, activities, audio, images, illustrations, design, and code are owned by us or our licensors and are protected by copyright and other laws.
You may view and use the content for your personal, non-commercial use. You may also link to any page and quote short passages with a link back to the original page. Any other use, including republishing articles, quizzes, or activities on another site or in an app, requires our written permission. To ask, use our contact form.
The name hear-in-noise and our logo may not be used in a way that suggests we endorse you or your product.
5. Links, products, and advertising
The Site links to research articles and other websites we don't control. We aren't responsible for their content, accuracy, or privacy practices, and a link is not an endorsement.
Mentions of hearing devices, treatments, products, or services are for general information only. They are not recommendations for your situation. Talk to an audiologist or doctor about which options suit you.
6. No warranties and limits on our liability
We work to keep our content accurate and up to date, and we cite our sources. But hearing research changes, and we can't guarantee that everything on the Site is complete, current, or error-free.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise that the Site will be uninterrupted, secure, or free of viruses or errors.
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OR HARM RESULTING FROM YOUR USE OF, OR RELIANCE ON, THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow certain of these limits, so some may not apply to you.
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site or your breach of these Terms.
7. Privacy and changes to these Terms
Our Privacy Policy explains what information we collect when you use the Site and how we use it.
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page, and for significant changes we'll post a notice on the Site. If you keep using the Site after an update, you accept the new Terms.
8. Governing law and contact
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules.
If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, we haven't waived our right to enforce it later.
